Unpaid Overtime
Nothing is more frustrating than failing to be paid for the time you have worked. California labor law states that nonexempt employees are to be paid an overtime rate of time and half their normal rate when they work more than eight hours a day or more than 40 hours a week. Sometimes employers are required to pay up to double the regular rate for hours worked in excess of 12 hours a day.
At times, an employer will wrongfully state that an employee is not entitled to overtime. For example, they will state that an employee is “exempt” from overtime though the tasks performed by that employee are not managerial and do not include any decision-making duties.
